Ex-Riverview director drops lawsuit against school district

The first director of Riverview Charter School has dropped the Beaufort County School District from a lawsuit she filed after her dismissal, according to court documents.

Eleanore Bednarsh and her husband, Gary, sued the district and Riverview Charter School in October 2010. The suit accuses her former employer of luring her to Beaufort with false promises, misrepresenting her responsibilities and firing her without cause.

The suit listed the school district, the district board of education and Riverview as defendants, as well as a district liaison to the school and several current and former members of the Riverview board of directors.

Court filings indicate the suit against the district was dismissed in late October. District spokesman Jim Foster confirmed that Bednarsh had dismissed all claims against the district, the school board and district human resources officer Jackie Rosswurm.

The school district had said previously it was not directly involved in the matter. The district never employed, supervised or fired Bednarsh, according to a statement issued in September 2010.

Bednarsh was hired in April 2009 at an annual salary of $90,000. She was fired in December 2009; Riverview officials have said she did not meet performance objectives.

Her suit claims the school never intended to honor her three-year contract. It says the school hired her to stick to its schedule for opening and ensure it received its charter on time. Riverview then contrived a reason to fire Bednarsh, the suit says.

Some of the complaints against the school and Riverview officials have been dismissed or consolidated, as well, court records indicate.

However, the suit still accuses the Riverview defendants of breach of contract and defamation.

The suit also claims Riverview failed to follow the S.C. Freedom of Information Act. Bednarsh's attorneys, J. Olin McDougall and A. Parker Barnes, requested emails, voice mails and other records related to Bednarsh and her employment through the act in March 2010, but claimed that responses to the requests were inadequate.

In June 2010, Bednarsh's offer to resolve the suit with a $242,000 payment was not accepted.
